ACCEPTANCE OF TERMS. 1. YieldQuest Funds (hereafter "YieldQuest"), invites you to view, use and download information from YieldQuest's web site subject to your agreement to comply fully with the following Terms of Use ("TOU"). YieldQuest reserves the right to update the TOU at any time without notice to you. The most current version of the TOU can be reviewed by clicking on the "Terms of Use" hypertext link located at the bottom of our Web pages.

2. PERSONAL AND NON-COMMERCIAL USE LIMITATION. Unless otherwise specified, the materials displayed on or available from YieldQuest's web site are for your personal and non-commercial use. 5. DISCLAIMER OF WARRANTIES. ALL CONTENT ON YIELDQUEST'S WEB SITE IS PROVIDED TO YOU ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. YieldQuest makes no warranty as to the accuracy, completeness, currency or reliability of any content or information available through this web site.

6. LIMITATION OF LIABILITY. YieldQuest shall not be liable to you for actual, direct, indirect, special, incidental, punitive, exemplary or consequential damages, including, without limitation, lost profits (hereinafter collectively referred to as "Damages") related in any way to your use of YieldQuest's web site or the content or information contained in or available from YieldQuest's web site, arising from any cause or cause of action whatsoever, including, but not limited to, any damages arising out of YieldQuest's alleged breach of contract or breach of warranty; any Damages arising out of YieldQuest's negligent acts or omissions; or any Damages for which YieldQuest is allegedly strictly liable. 7. CONFIDENTIALTIY. YieldQuest shall treat all information regarding the Client furnished to YieldQuest Funds, Inc. as strictly confidential. YieldQuest shall comply with all federal and state laws, rules and regulations of regulatory agencies, protecting the confidential information and privacy rights of the Client, including, without limitation, Title V of the federal Gramm-Leach-Bliley Act. YieldQuest shall not disclose such confidential client information to any affiliate, or any unaffiliated entity or person for any purpose other than to perform the activities contemplated by the normal course of YieldQuest's business dealings with Clients or by applicable law.

9. LINKS TO THIRD PARTY SITES. YieldQuest may include links to sites owned, operated or maintained by persons or entities other than YieldQuest as a convenience to you. The inclusion of any link does not imply endorsement by YieldQuest of the services, products, information or advice on the site to which the link relates. The linked sites are not under the control of YieldQuest and YieldQuest is not responsible for the content of any linked site or any link contained in a linked site, or any changes or updates to such sites. The views, opinion, statements, offers or other information or content expressed on such sites are those of the owner(s), operator(s), author(s) or distributor(s) of such sites and not YieldQuest.
